Preamble
The following provisions establish the general conditions of sale (the "General Conditions") of the products offered by Atelier Camille on its website www.ateliercamille.com (the "Site"). Atelier Camille is a SARL registered with the RCS of Paris under number 807 394 457. Camille TEMPLIER is its manager. For the purposes of the present contract, it is agreed that the user of the Site (the "User") and Atelier Camille will be collectively referred to as the "Parties" and individually referred to as the "Party", and that the User who has validated an order will then be referred to as the "Buyer". The rights and obligations of the User necessarily apply to the Buyer. Any User wishing to purchase from the Site declares that he/she has full legal capacity. Any order for a product offered on the Site implies consultation and express acceptance of the General Terms and Conditions, without this acceptance being conditional upon a handwritten signature by the User. In application of article 1369-5 of the French Civil Code, electronic contract validation is based on the "double-click" principle, whereby the on-line purchaser can check the details of his/her order and its total price, in order to correct any errors, and then confirm his/her order to express his/her acceptance.
Article 1. Purpose
The purpose of these General Terms and Conditions is to define the mutual rights and obligations of the Parties, and the various stages of the order process, exclusively for the purposes of the relationship they establish on the Internet. In the event of a breach of any of these terms and conditions, such breach shall be deemed to be governed by current practice in the distance selling sector for companies having their registered office in France.
Article 2. Products
The products offered for sale by Atelier Camille (the "Products") are those shown on the www.ateliercamille.com website. The Products are described and presented as accurately as possible. The photographs and texts illustrating the Products attempt to describe their essential characteristics as accurately as possible. The Products comply with the regulations in force in France. Atelier Camille cannot be held responsible for any failure to comply with the legislation of another country to which the Products are delivered, which it is the responsibility of the Buyer to check. The Buyer is solely responsible for the choice of Products, their conservation and their use.
Article 3. Prices
Prices are quoted in Euros, inclusive of all taxes, but exclusive of customs duties and other taxes. Customs duties and other taxes must be paid by the customer directly to the carrier. They take into account any discounts and VAT applicable on the date of the order. The prices indicated do not include delivery charges, which will be invoiced in addition and will be specified to the customer at the time of final validation of the order.
Period of validity of the offer and the price: the prices are indicated for a period of 6 months and Atelier Camille reserves the right to modify its prices in the event of promotions or sales for example. The Products will be invoiced on the basis of the prices in force at the time the order is registered. The Products remain the property of Atelier Camille until full payment has been received. In the event of non-payment by the Buyer of all or part of the price of the order, Atelier Camille reserves, until full payment, a right of ownership on the products sold, allowing it to repossess said products by any means.
Article 4. Right of withdrawal - Refunds and returns
In accordance with article L.221-18 of the French Consumer Code, the non-professional Customer has a period of fourteen (14) days from receipt of the Order to exercise his/her right of withdrawal from Atelier Camille.
You can exercise your right of withdrawal either by logging on to your customer account in the "Orders" section, or by downloading and printing the returns form available in the "Returns & Delivery" tab.
The right of withdrawal is exercised without penalty.
The Customer shall return the Order, without undue delay and, at the latest, within fourteen (14) days of communicating his decision to withdraw, in accordance with Article L. 221-21 of the French Consumer Code.
After this period of fourteen (14) days, the sale is firm and final. The Product must be returned in its original packaging, in its original condition, new, unworn and unwashed. To make a return, the Customer must follow the procedure indicated on the returns form downloaded from the site.
The return of Products is at the Customer's expense and risk.
The reimbursement of the Order by Atelier Camille will be made at the latest within five (5) days from the date of receipt of the return in its offices.
Atelier Camille will make the refund using the same means of payment that was used to pay for the Order, unless the Customer expressly agrees that Atelier Camille may use another means of payment. Atelier Camille shall not be liable for refunds on expired means of payment.
The reimbursement of an order paid with a gift card or a credit note will be automatically reimbursed as a credit note.
If the Customer fails to comply with these GTC, Atelier Camille will not be able to refund the Products concerned. In all cases, Atelier Camille is responsible for return shipping costs if the Product delivered to the Customer is different from the Product ordered or if it is delivered damaged.
